Dr Sonu Goel, a distinguished public health expert and chairperson of the Tobacco Control Section explained that e-cigarettes, also known as Electronic Nicotine Delivery Systems (ENDS), vaporise a nicotine solution instead of burning tobacco leaves.
Vape products are taxed at the sales tax rate rather than the tobacco or cigarette tax rate. While vape products are not covered by the Smoke-free Air Act, each business can prohibit the use of vape devices indoors, but this is not required by state law. Electronic nicotine and vapor delivery systems, which include e-cigarettes, vaping pens, e-hookah and similar devices, typically contain nicotine. Some ingredients found in e-cigarettes are considered toxic and there is no regulation of what chemicals e-cigarettes contain or how much nicotine the user is inhaling. These factors could lead to long-term adverse health effects for e-cigarette users and bystanders. This new law will reduce exposure to the potentially dangerous chemicals for e-cigarette users and those around them. Prior to electronic cigarettes being added to the Clean Indoor Air Act, only the smoking of substances containing tobacco, including cigars, cigarettes or pipes, were restricted in public places. While many counties have already banned the use of e-cigarettes in public places, including restaurants, bars and other work places, this bill makes the law consistent across New York State.
In contrast, other studies found acute microvascular endothelial dysfunction, increased oxidative stress and arterial stiffness in smokers after exposure to e-cigarettes with nicotine, but not after e-cigarettes without nicotine (reviewed in [20]). In women smokers, a study found a significant difference in stiffness after smoking just one tobacco cigarette, but not after use of e-cigarettes (reviewed in [20]). However, research updates on, and analysis of, the potential health benefits/risks of e-cigarettes are outside the scope of TobaccoTactics. In 2017, the campaign began prioritizing e-cigarette prevention messaging to combat increasing youth vaping rates. "The Real Cost" campaign also educates teens on the health consequences of smoking cigarettes. Given that there is no safe tobacco product, youth and adults who do not use tobacco products should not start using e-cigarettes. Vaping and smoking both involve inhaling nicotine and other substances into your lungs. E-cigarettes heat liquid to make an aerosol; cigarettes burn tobacco, which creates smoke.

Fetal exposure to e-cigarettes can adversely affect the development of the fetus in pregnant women. Exposure to emissions from e-cigarettes also poses risks to bystanders. E-cigarettes may help nonpregnant adults quit smoking cigarettes if they are used as a complete substitute for all smoked tobacco products. In response to this issue, the PACT Act Amendment prohibits sellers from using the U.S. Post Office to ship e-cigarettes, vapes, flavored and smokeless tobacco products. The PACT Act applies to all shipments in interstate commerce (15 U.S.C. § 376) as well as to all delivery sales. Some people who smoke choose to use both cigarettes and e-cigarettes at the same time on an ongoing basis, whether they are trying to quit or not.
Until we know more, it is probably best to avoid these products whenever possible, including secondhand smoke. However, vaping early on may increase the chances of smoking ordinary cigarettes later in life. Vaping has become an epidemic among young people in the United States.
An assessment from the agency, issued in 2008, references only a couple of studies that cover inhalation exposures—all with laboratory animals rather than people. The minimum age to purchase e-cigarettes and other tobacco products has also been raised to 21. A bill was also introduced in 2022 to raise the minimum age to purchase tobacco products and vapes from 19 to 21, but it was vetoed by Governor Mike Dunleavy.
Probably the worst thing a parent could do for their child would be to buy an e-cigarette under the misconception that this might prevent them from smoking regular cigarettes, Krishnan-Sarin says. She encourages parents to talk openly and freely about vaping—with the caveat that they provide accurate information. "I think the problem is that parents lose credibility if they say something to try and convince their child, who then finds out that it isn’t true," she says. Among girls, only a higher proportion of never-users in the school remained protective for S-SM and S-EC. Among boys, the same was observed for S-EC, whereas a higher proportion of students with positive attitudes towards snus use in one’s age group increased S-SN. Interestingly, a higher proportion of students planning for general upper secondary education had lowered S-EC and S-SN in the univariate analyses but increased S-SM and S-SN in the multivariate models. This may reflect, for instance, more complex interactions between individual- and school-level factors influencing susceptibility among boys. In general, students with positive attitude towards product use in one’s age group and current use of some other tobacco or nicotine product had consistently higher susceptibility regardless of product type.
